Collation is based on the presumption that the testator/testatrix wishes to benefit all descendants equally in life and in death. A direct descendant of a testator/testatrix will thus be required to account to the estate (collate) any donation received during the testator/testatrix’s lifetime so that this may be offset against such a descendant’s inheritance. Should the testator/testatrix intend to relieve any of his descendants from the obligation to collate, this intention should be clearly expressed in his or her will.
