An agreement in terms of which the parties who are entitled to receive something from the estate (heirs, legatees and surviving spouse married in community of property), are given the option to exchange their specified asset for another asset of the same value. There is thus only a redistribution of assets that are bequeathed to each heir while the value of each heir’s inheritance remains the same.
